WHEREAS, the Council of the Village of Apple Creek, Ohio (“Village”) passed Ordinance No. 2016-1 on February 1, 2016, in order to establish the schedule of compensation and benefits for non-elected employees of the Village; and

Ordinance 2016-28 Amending the Appropriations

ORDINANCE NUMBER 2016-28

AN ORDINANCE AMENDING THE 2016 APPROPRIATION ORDINANCE 2015-31 PASSED DECEMBER 14, 2015 , AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE Council of the Village of Apple Creek, County of Wayne, State of Ohio:

SECTION 1. That the Sewer Fund shows an increase in Revenue and Expenses of $31,252.00, from money received from Ohio Public Works Commission for Engineering of the Sewer Line Extension to the Waynedale Campus.

 

     That this Ordinance is hereby declared to be an emergency Ordinance by reason of the fact it is necessary to immediately amend the 2016 Appropriations to meet current expenses: and that is necessary, therefore, for the public peace, health and safety and shall be effective immediately allowed by law.

AN ORDINANCE APPROVING THE TERMS OF AN ACQUIRED EASEMENT FROM APPLE RIDGE, INC., AUTHORIZING THE MAYOR TO EXECUTE SAID EASEMENT, AND DECLARING AN EMERGENCY.

WHEREAS, an open drainage ditch servicing the Apple Ridge Allotment abuts and traverses the property of Apple Ridge, Inc., identified as Lot 389, Apple Ridge Alt. No.1 , within the Village of Apple Creek; and

Ordinance 2016-18 Easement From Village Ag-Land, LLC

ORDINANCE NUMBER 2016-18

AN ORDINANCE APPROVING THE TERMS OF AN ACQUIRED EASEMENT FROM VILLAGE AG-LAND, LLC, AUTHORIZING THE MAYOR TO EXECUTE SAID EASEMENT, AND DECLARING AN EMERGENCY.

WHEREAS, with the creation of the Apple Creek-East Union Township Joint Economic Development District 2, village sewer services shall be extended to the Southeast Local School District main campus; and

WHEREAS, in the interests of fiscal responsibility and expediency for public health purposes, the most direct route to provide sewer services requires a sewer pipeline over the property of John & Sylvia Reber; and

WHEREAS, Village Ag-Land, LLC have agreed to provide a sewer line easement to the Village of Apple Creek, Ohio, in accordance with the terms and conditions of that easement attached hereto as Exhibit AA@;

NOW THEREFORE, BE IT RESOLVED by the Council of the Village of Apple Creek, Ohio, that:
