Council Meeting Minutes 9-6-16

The Regular Meeting of the Apple Creek Council was called to order on September 6, 2016, by Mayor Betty Keener with the following council members answering to roll call:

Rick Conrad-present, Mike Harwood-present, Rodney Mackey-present, Robert McCarthy-arrived at 6:40 pm, Charlie Lewis-present, and Steve Stoffer-present.

Councilperson Conrad made a motion to approve the minutes of the August 15, 2016 meeting, as always the minutes are available for the public to review. The motion was seconded by Councilperson Stoffer. Roll call vote was as follows: Councilperson Conrad-yes, Councilperson Stoffer-yes, Councilperson Harwood-yes, Council President Mackey-yes, and Councilperson Lewis-yes.

VISITORS: Emily Morgan from the Daily Record was in attendance.

A motion to go into executive session for personnel 121.22 (G)(1) and potential litigation section 121.22 (G)(3) was made by Councilperson Conrad and seconded by Council President Mackey with roll call vote as follows: Councilperson Conrad-yes, Council President Mackey-yes, Councilperson Harwood-yes, Councilperson Lewis-yes, and Councilperson Stoffer-yes.  Motion carried and Council went into executive session at 6:32 pm.

A motion to come out of executive session was made by Council President Mackey and seconded by Councilperson Stoffer with roll call vote as follows: Council President Mackey-yes, Councilperson Stoffer-yes, Councilperson Conrad-yes, Councilperson Harwood-yes, Councilperson McCarthy-yes, and Councilperson Lewis-yes. Motion carried and Council came out of executive session at 6:53 pm.

Action from executive session:

Councilperson Stoffer made a motion to hire Tim Etzwiler for the part-time street position on the condition that Mr. Etzwiler passes his drug screening and background check.  The motion was seconded by Council President Mackey with roll call vote as follows: Councilperson Stoffer-yes, Council President Mackey-yes, Councilperson Conrad-yes, Councilperson Harwood-abstained, Councilperson McCarthy-yes, and Councilperson Lewis-yes.  Motion carried.

Council President Mackey made a motion to delay the income tax for Southeast Local Schools until there is a timeline in place for the sewer line extension project. The motion was seconded by Councilperson McCarthy with roll call vote as follows: Council President Mackey-yes, Councilperson McCarthy-yes, Councilperson Conrad-yes, Councilperson Harwood-no, Councilperson Lewis-yes, and Councilperson Stoffer-yes.  Motion carried.

POLICE: Chief Jason Woodruff reported that Chance Sigler is being trained. The Chief thanked the Harwood family for the gift card given to the police department.  The holiday activities schedule was submitted to Council for approval: Trick-or-Treat on Saturday October 29th from 4 to 6 pm, Tree Lighting Ceremony on December 16th at 7 pm, and Breakfast with Santa on Saturday December 17 from 8 am to 11 am.

PARK: Discussion was held regarding food vendors for baseball during the Johnny Appleseed Festival.  The Mayor did not contact the ACYAA Commissioner at this point in time.  The ACYAA had a food truck for the whole week.  There was discussion as to whether this food vendor should pay to remain during Johnny Appleseed Days.  A motion was made by Councilperson Stoffer to let the ACYAA have one food vendor without fee during the Festival.  The motion was seconded by Councilperson McCarthy.  Roll call vote was as follows:  Councilperson Stoffer-yes, Councilperson McCarthy-yes, Councilperson Conrad-yes, Councilperson Harwood-no, Council President Mackey-yes, and Councilperson Lewis-yes.  Motion carried.

STREETS AND MAINTENANCE: Street Commissioner Orr gave an update on Melway chip and sealing.   Two building owners need to clean their properties.  Sign are all up.

WATER & SEWER: 208 Maps & 201 Red Line in the process of being updated.   The Mayor presented and explained the Engineering and Associates draft maps to Council.

CORRESPONDENCE: Nothing.

UNFINISHED BUSINESS: The August 15th Council meeting was previously announced on August 1 and July 18 in regards to a change in start-time to 6 p.m.  This was done so Council could go to the Historical Society Building. Further, this change in meeting time was in the Daily Record article and on the Village website. Councilperson Harwood chose to not discuss the time issue further and requested for the Mayor to move on with the meeting.

NEW BUSINESS:   Ordinance 2016-22, An Ordinance Amending the 2016 Appropriation Ordinance 2015-31 Passed December 14, 2015, and Declaring an Emergency.   A motion to suspend the rules and advance to the second and third readings by title only was made by Councilperson McCarthy and seconded by Councilperson Conrad.  Roll call vote was as follows: Councilperson McCarthy-yes, Councilperson Conrad-yes, Councilperson Harwood-yes, Council President Mackey-yes, Councilperson Lewis-yes, and Councilperson Stoffer-yes.   Motion carried.

A motion to pass Ordinance 2016-22 was made by Councilperson Conrad and seconded by Council President Mackey.  Roll call vote was as follows: Councilperson Conrad-yes, Council President Mackey-yes, Councilperson Harwood-yes, Councilperson McCarthy-yes, Councilperson Lewis-yes, and Councilperson Stoffer-yes.   Motion carried.

COMMITTEE REPORTS: CIC next meeting will be on September 19th at 5:30p.m.

Councilperson Lewis stated that the alley behind the Dollar General has boxes stacked that are restricting access in case of emergency.   The manager, Jon Nai Spring, will be contacted by letter regarding this matter.
