Council Meeting Minutes August 3, 3015

Before the regular meeting, there was a public hearing on JEDD#2 at 6:00 pm.

The Regular Meeting of the Apple Creek Council called to order on August 3, 2015 by Betty Keener with the following council members answering to roll call:

Rick Conrad-present, Mike Harwood-present, Rodney Mackey-present, Robert McCarthy-present, Steve Stoffer-present, and Charlie Lewis-absent.

Ordinance 2015-21 An Ordinance Approving the Apple Creek-East Union Township Joint Economic Development District 2 Contract and Declaring An Emergency. Motion to suspend the rules and advance to the second and third reading by title only by Mike Harwood, Seconded by Rodney Mackey, Roll Call: Mike Harwood-yes, Rodney Mackey-yes, Rick Conrad-yes, Robert McCarthy-yes, and Steve Stoffer-yes.

Motion to pass Ordinance 2015-21 by Mike Harwood, Seconded by Rodney Mackey, Roll Call: Mike Harwood-yes, Rodney Mackey-yes, Rick Conrad-yes, Robert McCarthy-yes, and Steve Stoffer-yes

At this point Robert McCarthy was excused.

Rodney Mackey made a motion to approve the minutes of the July 20, 2015 meeting. As always they are available for the public to review. Seconded by Steve Stoffer, Roll Call: Rodney Mackey-yes, Steve Stoffer-yes, Rick Conrad-yes, and Mike Harwood-yes.

Motion to go into executive session for Personnel 121.22 (G) (1) by Rick Conrad, Seconded by Rodney Mackey, Roll Call: Rick Conrad-yes, Rodney Mackey-yes, Mike Harwood-yes, and Steve Stoffer-yes. At 6:33 pm.

No Action from executive session.

Rick Conrad made a motion to pay Robert McCarthy for tonight’s meeting. Seconded by Steve Stoffer, Roll Call: Rick Conrad-yes, Steve Stoffer-yes, Mike Harwood-yes, and Robert McCarthy-yes.

VISITORS: None.

POLICE: Chief Jason Woodruff was present and gave his report for the month of July. Officer Bob Selby has gone from part-time status to auxiliary status. Matt Estacion found Mayer Carson hall opened again. There were no keys out at the time. They will keep checking it in the evening and street department will check it every morning. Rodney Mackey thanked Jason for his care of the horse from the buggy accident. Jason made sure the horse was examined by a Veterinarian.

PARK: Curry Lumber has offered to purchase new tables for Mayer Carson Hall to replace the old heavy ones. He would like to be able to use the park at no cost in exchange for the tables. Mike Harwood made a motion to allow Curry Lumber to have the use of the park for 10 years at no cost and to be reviewed for continuance at that time. Seconded by Rick Conrad, Roll Call: Mike Harwood-yes, Rick Conrad-yes, Rodney Mackey-yes, and Steve Stoffer-yes.

STREETS AND MAINTENANCE: Resolution 2015-20 A Resolution Transferring Monies from the General Fund to the Street Fund.

WATER & SEWER: Resolution 2015-19 A Resolution Authorizing Betty Keener, Village of Apple Creek Mayor, To submit An Application to Participate in the Ohio Public Works Commission State Cap[ital. Improvement Program and to Execute Contracts as Required.

Motion to pass by Rick Conrad, Seconded by Rodney Mackey, Roll Call: Rick Conrad-yes, Rodney Mackey-yes, Mike Harwood-yes, and Steve Stoffer-yes.

Opening of the bids for the water plant upgrade on August 6th at noon.

Mayor Betty Keener explained that the Village is not eligible for the 1.07% loan for the water treatment plant because our rates are too low to qualify. We will have to take a loan at 3.57%. The total bill must be 2.2 percent of the LMI survey. Betty is working on a water/sewer rate study and will provide it to the Water/Sewer Committee at their next meeting.

Steve Stoffer made a motion to accept Suttle’s bid of $6,876.70 for the garage door to be installed on the water treatment plant building. Seconded by Rick Conrad, Roll Call: Steve Stoffer-yes, Rick Conrad-yes, Mike Harwood-yes, and Rodney Mackey-yes. This was the lower of the two bids.

JEDD#2: The public meeting was tonight and the only people who showed up were Township Trustee Joe Rabatin and from the School Board Tim Suppes and Mrs. Suppes.

JEDD #1: Nothing.

CORRESPONDENCE: Nothing.

UNFINISHED BUSINESS: Third Reading of Ordinance 2015-17 An Ordinance Defining Employee and Dependent Eligibility For Health Insurance Coverage, and amending Ordinance 2004-06. Motion to pass by Mike Harwood, Seconded by Rodney Mackey, Roll Call: Mike Harwood-yes, Rodney Mackey-yes, Rick Conrad-no and Steve Stoffer-yes, Motion carried.

Dale Orr reported he went to a house on Oberly Drive to replace a water cap and while he was there he noticed the owner of the house and put up a garage on the Village’s easement. He talked to the owner and after some discussion the owner went and got his deed and it does show the easement. He is 5 feet from our water line going into the Dover tower. Laurie called the Wayne County Building Department to inquire about a building permit and they are sending an inspector to the property, and will get back with the Village.

NEW BUSINESS: Betty Keener explained she would like Village to consider Codifying the Ordinances. Some advantages will be the ordinances will be organized, easier search capability and the PD could more easily reference when writing Citations.

A special council meeting is being called for August 10th at 6:30 pm, with the Water & Sewer Committee meeting at 5:30 pm prior to Council.
