Council Meeting Minutes June 5, 2107

The Regular Meeting of the Apple Creek Council was called to order on June 5, 2017, by Mayor Betty Keener with the following council members answering to roll call:

Rick Conrad-present, Mike Harwood-present, Rodney Mackey-present, Robert McCarthy-present, Charlie Lewis-absent, and Steve Stoffer-present.

A motion to approve the minutes of the May 15, 2017 meeting was made by Councilperson Conrad, as always the minutes are available for the public to review.  The motion was seconded by Councilperson Harwood. Roll call vote was as follows: Councilperson Conrad-yes, Councilperson Harwood-yes, Council President Mackey-yes, Councilperson McCarthy-yes, and Councilperson Stoffer-yes.   Motion carried.

VISITORS: Suzanne Waldron was present; she is running for Wayne County Municipal Court Judge due to Judge Millhoan not seeking re-election. She presented information about herself and handed out brochures.  Also, Kevin Lewis was present from the OCA, Ohio Laborers Union and Contracts Association.  He stated that he is making connections with local governments, and explained that when projects are bid, if not enough bids are received, members of their association could give additional opportunities for negotiations.  He left his card and information for Council.

POLICE:  Chief Woodruff was present.  An offer of $3900 for the Charger as a trade-in has been received.  The Chief explained that the Charger can be auctioned with the hope of receiving at least $3900 or it can be traded-in to State Wide Ford against the new cruiser.  The condition of the Charger was discussed.  The Mayor conferred with the Solicitor regarding the trade-in option. An act of Council can authorize such.  This issue was tabled since the new car will not be received for two more months.  On-line Charger sale prices will be researched.  The new K-9 cruiser is in service.  The Charger is out of service and the equipment will be stripped out of it.  The equipment will be auctioned off.  Radios, radar unit and lap-tops will be transferred to the new vehicle.  The Click-it-or-Ticket campaign is in progress. The monthly report was presented.  The numbers and calls were reviewed.  There were a couple of drug arrests.  Fraud situations were discussed.

STREETS AND MAINTENANCE: Street Commissioner Orr reported he is training the new employee; things are going well.   Cold patching is being done to assist with the training.

PARK:     Nothing.

WATER & SEWER: All documents have been signed for the Waynedale project, and sent in, the Mayor reported.  Income tax payments from Waynedale are to begin soon.  An explanation of the pay-in process was given to the Superintendent.  Waynedale taxes need to be separated from the other school in Apple Creek for JEDD purposes.

JEDD#1:  Nothing.

JEDD#2:   Next meeting will be July 12, 2017 6:00 pm at Village Hall.

CORRESPONDENCE: Mayor Keener received thank you letters from the second-graders at the Apple Creek Elementary school for her speaking to them about local government recently.

UNFINISHED BUSINESS:    The property owners at 808 W. Main St. need an easement for storm water run-off. Solicitor Musselman will get with Commissioner Orr and have the easement prepared for the next meeting.


COMMITTEE REPORT: Next CIC meeting will be on June 19, 2017, at 5:30 pm, at the Village hall.

A MOTION TO PAY THE BILLS: was made by Council President Mackey, seconded by Councilperson Stoffer. The roll call vote was as follows: Councilperson McCarthy-yes, Councilperson Stoffer-yes, Councilperson Conrad-yes, Councilperson Harwood-yes, and Council President Mackey-yes.   Motion carried.

A motion to go into executive session for Personnel section 121. 22 (G)(1) was made by Councilperson Conrad, seconded by Council President Mackey. The roll call vote was as follows: Council President Mackey-yes, Councilperson Conrad-yes, Councilperson McCarthy-yes, Councilperson Harwood-yes, and Councilperson Stoffer-yes. Council went into executive session at 7:04pm.

A Motion to come out of executive session was made by Council President Mackey; the motion was seconded by Councilperson McCarthy.  Roll call vote was as follows: Council President Mackey-yes. Councilperson McCarthy-yes, Councilperson Conrad-yes, Councilperson Harwood-yes, and Councilperson Stoffer-yes.   Council came out of executive session at 7:44pm.

While in executive session, Council discussed the spousal language from Ordinance 2015-17 no change will be made at this time.

A MOTION TO ADJOURN: was made by Councilperson Harwood, seconded by Councilperson Stoffer. Roll call vote was as follows: Councilperson Harwood-yes, Councilperson Stoffer-yes, Councilperson Conrad-yes, Council President Mackey-yes, and Councilperson McCarthy-yes.   Motion carried.
