Council Meeting Minutes Sept. 19, 2016

The Regular meeting of the Apple Creek Council was called to order on September 19, 2016, by Mayor Betty Keener with the following council members answering to roll call:

Rick Conrad-present, Mike Harwood-present, Rodney Mackey-present, Robert McCarthy-present, Charlie Lewis-present, and Steve Stoffer-present.

Councilperson Stoffer made a motion to approve the minutes of the September 6, 2016 meeting, as always the minutes are available for the public to review. The motion was seconded by Councilperson McCarthy with roll call vote as follows: Councilperson Stoffer-yes, Councilperson McCarthy-yes, Councilperson Conrad-yes, Councilperson Harwood-yes, Council President Mackey-yes, and Councilperson Lewis-yes.   Motion carried.

VISITORS: Leonard Kaplan.

A motion to go into executive session for personnel 121.22 (G)(1) was made by Council President Mackey and seconded by Councilperson Stoffer. Roll call vote was as follows: Council President Mackey-yes, Councilperson Stoffer-yes, Councilperson Conrad-yes, Councilperson Harwood-yes, Councilperson McCarthy-yes, and Councilperson Lewis-yes. Motion carried.  Council went into executive session at 6:32 pm.

A motion to come out of executive session was made by Councilperson Conrad and was seconded by Council President Mackey. Roll call vote was as follows: Councilperson Conrad-yes, Council President Mackey-yes, Councilperson Harwood-yes, Councilperson McCarthy-yes, Councilperson Lewis-yes, and Councilperson Stoffer-yes.  Motion carried. Council came out of executive session at 6:42 pm.

POLICE: Trick or Treat will be held on October 29th from 4 to 6 pm. Tree Lighting will be on December 16th at 7 pm, and Breakfast with Santa on December 17th from 8 to 11 am. Sergeant Estacion was in attendance but had nothing to report.

PARK: Mayor Keener reported that Street Commissioner Orr will be obtaining a lock for the door on the stage.   Mayor Carson Hall cleaning was discussed.

STREETS AND MAINTENANCE: OPWC Grant.   Resolution 2016-24 A Resolution Authorizing the Mayor to Prepare and Submit An Application to Participate in the Ohio Public Works Commission State Capital Improvement Program and to Execute Contracts as Required. A motion to pass said Ordinance was made by Councilperson Harwood with the motion being seconded by Councilperson McCarthy.  Roll call vote was as follows: Councilperson Harwood-yes, Councilperson McCarthy-yes, Councilperson Conrad-yes, Council President Mackey-yes, Councilperson Lewis-yes and Councilperson Stoffer-yes.  Motion carried. Other options will be reviewed if the grant request fails.

Councilperson Harwood asked if Melway is coming soon to chip and seal the streets. Commissioner Orr reported Melway has advised that they are coming in sometime this week. If they don’t, the project will probably be delayed until next spring.

WATER & SEWER:  Resolution 2016-23 A Resolution to enter into an Agreement with Wayne County for Intergovernmental Wastes Water Service. The resolution was discussed. A motion to pass was made by Councilperson Conrad and seconded by Councilperson Harwood.   Roll call vote was as follows: Councilperson Conrad-yes, Councilperson Harwood-yes, Council President Mackey-yes, Councilperson McCarthy-yes, Councilperson Lewis-yes, and Councilperson Stoffer-yes.   Motion carried.

Mayor Keener reported there is no new timeframe for the Waynedale sewer-line extension project, therefore, there is no need for Gary Daugherty to attend the next meeting.

JEDD#1: Nothing.

JEDD#2: Council President Mackey reported that setting up a meeting is being worked on.

CORRESPONDENCE: A letter from Wayne County Park District was received.  The Barns Preserve was completed and is totally handicap accessible.  The letter will be available for Council to read.  A total of $350,000 was received from grants and donations to construct the Preserve.

UNFINISHED BUSINESS: Nothing.

NEW BUSINESS: Nothing.

COMMITTEE REPORTS: Update from CIC-The Johnny Appleseed Festival for 2017 was discussed.  Things need to be shaken-up to make it more attractive to more people.  The proceeds for this year’s Festival are being finalized.  It appears to be about $5,000 in the hole.  The possibility of a beer-tent or beer area for Friday night is being considered.  Hopefully, this would bring in the younger generation.  A motion to support having alcohol at the Festival for one night was made by Councilperson Hardwood and seconded by Council President Mackey.  Roll call vote was as follows:  Councilperson Hardwood-yes, Council President Mackey-yes, Councilperson Conrad-yes, Councilperson McCarthy-abstain, Councilperson Lewis-yes, and Councilperson Stoffer-no.  Motion carried.

Ordinance Codification and the copier lease were discussed. Buy-out of the copier lease was approved dependent on terms.
