February 2, 2015 Council Meeting Minutes


The Regular Meeting of the Apple Creek Council called to order on February 2, 2015 by Mayor Betty Keener with the following council members answering to roll call:

Rick Conrad-present, Mike Harwood-present, Rodney Mackey-present, Charlie Lewis-present, Steve Stoffer-present, and Robert McCarthy-late.

Charlie Lewis made a motion to approve the minutes of the January 19, 2015 meeting.  As always, they are available for the public to review. Seconded by Rick Conrad. Roll Call: Charlie Lewis-yes, Rick Conrad-yes, Mike Harwood-yes, Rodney Mackey-yes, and Steve Stoffer-yes.

VISITORS: Leonard Kaplan just visiting.


POLICE: Chief Jason Woodruff reported that the village did have a very nasty domestic in January with a stabbing. We are still dealing with this.

PARK:  Dale reported he had gotten 3 quotes for the repair of the electric. Kidron Electric price is $2,565.00, AC Split Bolt is $2,800.00 and Water Watts is $2,150.00. This is a 200 amp service with a 30 circuit breaker panel which is fed off 400 amps. We are going to put in 5-110 receptacles in the kitchen and 1-230 amp. Each is going to have a dedicated breaker. Four of the five 110 lines are going on the east wall and 1-110 and the 230 circuit on the north wall. Mike Harwood made a motion to accept the quote from Water Watts for $2,150.00. STREETS AND MAINTENANCE: Dale reported it’s been a trying time with the snow & ice, and the Street Department is doing the best they can. Dale reported he cannot fill the holes on the roads because we don’t have any filler. High Street has a very bad whole. Street committee will need to meet in March and take a road trip around town and prioritize the streets needing repair.

Matt Estacion was sworn in by Solicitor Jeff Musselman with many of his friends and family present.

WATER & SEWER:    Dale reported about the water main break from Friday January 23 on Church Street caused when AEP had hit one of our lines. They stated they had called Oops, but it came back that it was in the township. So from now on they will call us any time an Apple Creek address shows up.

Resolution 2015-5 A Resolution to Enter into a Water Pollution Control Loan Fund Agreement as a Borrower with the Ohio Environmental Protection Agency and The Ohio Water Development Authority, authorizing the Mayor of the Village of Apple Creek To Executive Said Agreement On Behalf Of The Village, and Declaring an Emergency.

Motion to suspend the rules and advance to the second and third reading by tittle only made by Rodney Mackey. Seconded by Steve Stoffer. Roll Call: Rodney Mackey-yes, Steve Stoffer-yes, Rick Conrad-yes, Mike Harwood-yes, Rob McCarthy – yes and Charlie Lewis-yes.

JEDD: Rodney Mackey reported that only the three members of the JEDD showed up for the meeting, being Dan Hodge, John Keener, and himself.  Mr. Steve Mast was unable to attend. Mr. Mast had relayed some information through Dan Hodge that he has been having a lot of break-ins. He is looking into some type of security and wanting Apple Creek Police. Rodney informed the committee Apple Creek is not interested. Also the Wayne County Development council is interested in what’s going on up there. They would like to get in touch with Steve. It was also mentioned that one of the Commissioners mentioned that (3) pipelines were going through Wayne County and they need a staging area. This information should be passed on by the JEDD to Steve Mast. Mike wanted to know if we had received any taxes. Laurie reported she had sent out two letters and has no response. The corporation taxes would not be due until April and he can ask for an extension until September. Rodney reported that the best he understands is there is not anyone working up there. Mike hears they are putting up chicken houses. Betty would like to address this subject again in April. Steve Mast has not attended a meeting with Council, the Township or JEDD. The next meeting will be scheduled around him. JEDD changed this meeting to accommodate Mr. Mast, but he wasn’t present. Dan Hodge called him two to three times before it got an answer.

CORRESPONDENCE: Aggregation rates for electric is 6.9 cents per kWh for and gas prices for a fixed rate $3.95/CCF. Gas will also have a variable rate available that was not provided. The residents will be receiving letters soon regarding sign up information.


NEW BUSINESS: Next council meeting will be Tuesday, February 17th at 6:30 p.m.

COMMITTEE REPORTS: Water & Sewer will meet on March 2nd at 5:00 p.m.
