The Regular Meeting of the Apple Creek Council called to order on January 5, 2015 by Betty Keener with the following council members answering to roll call:

Rick Conrad-present, Rodney Mackey-present, Robert McCarthy-present, Charlie Lewis-present, Steve Stoffer-present, and Mike Harwood-late.

Charlie Lewis made a motion to approve the Minutes of the December 15, 2014 meeting.  As always, they are available for the public to review.  Seconded by Steve Stoffer.  Roll Call: Charlie Lewis-yes, Steve Stoffer-yes, Rick Conrad-yes, Mike Harwood-yes, Rodney Mackey-yes, and Robert McCarthy-yes.

Motion to go into executive session for Contracts Section 121.22 (G)(3) by Steve Stoffer, Seconded by Rodney Mackey, Roll Call:  Steve Stoffer-yes, Rodney Mackey-yes, Mike Harwood-yes, Rick Conrad-yes, Robert McCarthy-yes, and Charles Lewis-yes, at 6:31 pm.

Motion to come out of executive session at 7:08 pm by Rodney Mackey. Seconded by Rick Conrad. Roll Call: Rodney Mackey-yes, Rick Conrad-yes, Mike Harwood-yes, Robert McCarthy-yes, Steve Stoffer-yes, and Charles Lewis-yes.

VISITORS: None.

ENGINEERS: Nothing.

POLICE:  Chief Jason Woodruff was present and handed out the Month of December’s report and yearend finishing the year with 519 calls for service. Jason reported there were no issues over Christmas and New Year. The state has been in to audit the leads program on the police’s computer and they have 2 areas to work on. Chief read a letter of resignation from Sergeant Nick Myrda; he has taken a job with the Mt.Vernon Police Department with his last of work to be January 15, 2015. Jason has asked any of the part-time officers if they would like the job, if not we will advertise for an employee, but would like to hire from within.

Rick Conrad made a motion to accept Nick’s resignation effective January 15, 2015. Seconded by Robert McCarthy. Roll Call: Rick Conrad-yes, Robert McCarthy-yes, Mike Harwood-yes, Rodney Mackey-yes, Charlie Lewis-yes, and Steve Stoffer-yes.

Mayor Betty Keener stated that Nick has been very instrumental in helping in the development of the Police Department. He was the only officer that was retained from the John Lowe issue in 2010.

PARK:  Nothing.

STREETS AND MAINTENANCE:   Nothing.

WATER & SEWER:    Resolution to come later.

JEDD: Meeting January 29th at 7 pm at the Fire Station.

CORRESPONDENCE:  Nothing.

UNFINISHED BUSINESS:  Certificate is in for the Aggregation and the pricing should be here next week.

NEW BUSINESS: New committee list was handed out. The only change is on the Park Committee with Rodney Mackey being removed and Mike Harwood added.

Resolution 2015-2 A Resolution to Enter Into A Contract with Simonson Construction Services, Inc. for the Apple Creek Wastewater Treatment Plant Improvement Project, Contingent Upon Final Approval of Financing By Ohio Environmental Protection Agency Department of Economic and Financial Assistance, and Declaring An Emergency,

Motion to suspend the rules and advance to the second and third readings by title only by Steve Stoffer, Seconded by Rodney Mackey, Roll Call: Steve Stoffer-yes, Rodney Mackey-yes, Rick Conrad-yes, Mike Harwood-yes, Robert McCarthy-yes, and Charlie Lewis-yes.

After the readings, motion to pass Resolution 2015-2 by Robert McCarthy. Seconded by Charlie Lewis. Roll Call: Robert McCarthy-yes, Charlie Lewis-yes, Rick Conrad-yes, Rodney Mackey-yes, Steve Stoffer-yes, and Mike Harwood-no. Resolution Passed.

Going back to the budget Betty asked if there are any questions. Steve Stoffer questioned the $100.00 in the appropriations. Laurie explained that’s the DUI fund. The Village has three small funds being the DUI and Drug and Law Enforcement (sale of property). These funds are all restricted for certain uses. Mike-when you list contractual services in different places is that like utilities. Laurie- yes its utilities, phone services and contracts; we have Dean’s Backflow, Engineering & Associates. These are some services we cannot control. Mike-like in the park contractual what is in that, it would be gas & electric. Laurie-every fund has contracts they are different. Mike- the municipal motor vehicle is this license tax, what is the $19,000.00. Laurie- that’s the diesel & gas. Mike-that’s for the whole Village? Laurie-yes that is correct. Steve explained that the tax on gasoline, every time you buy gas that’s what this is. Laurie- we spent that much on fuel over the year. Steve-we get 7 1/2. Laurie but that is the State Highway Fund not this one. Mike-is this all expenditures. Laurie-yes the revenue was done last year in June and reported to the county in July; at this point we are only dealing with the expenditures. Mike-you said then the gas if or street & police department. Do we bid that out or is it. Laurie-we use Santmyer Oil to deliver our fuel. Mike-did we ask anyone else. Laurie-I have not been involved with that. Laurie asked Dale if we have ever asked anyone else. Dale-the tanks belong to Santmyer Oil. Mike-just a question when we get them filled; do we have a contracted rate throughout the year to get them filled.  Right now gas is $2.00; I wish I had a 100 gallon tank to fill. Dale-they come in and monitor the usage and fill us when they have a truck in the area. Mike-so right now it’s really low; can we say hey can you fill us up at $2.00 a gallon versus waiting for them to come in. Dale-he has never called them, this was one thing set up with them; they come in and fill it whenever. Betty-is that by their choice or ours? Dale- I don’t know. Betty-is that the way it’s always been? Dale- that’s what it has always been. Betty- to Mike’s point why couldn’t we call when the price is down and have them fill it up. Like if you needed heating oil for your house; why can’t we call them when the prices are down. If that something we could check into. Mike- I just didn’t know if we had a contracted rate throughout the course of the year for $2.50 or $3.00 per gallon. Betty- it’s the going rate. Mike-hey if it’s $2.00 a gallon; let’s fill that thing up. Betty-it’s something to keep our eye on; while the prices are down we could manage when that tank is filled, let’s not wait for it to get low and let the prices go up which they will and then fill it at their discretion. I think it’s something we should manage. Dale will you please check on this and let us know. Steve do we pay taxes on that. Laurie- no. Mike- taxes are just a percentage. The government makes more money on fuel than anyone else; but I am saying if that oil is so low, I am looking at  buying a tank 500 gallons. Not in Apple Creek; just outside the Village.

Betty- anymore questions. Charlie- what size are the tanks we have: Dale- I think 500 and 300 gallons. Steve- the tanks are self-contained so if they spring a leak it’s covered.

Ordinance 2015-1 An Ordinance to make appropriations for Current Expenses and other Expenditures of the Village of Apple Creek, State of Ohio, during the fiscal year ending December 31, 2015 and declaring an emergency.

COMMITTEE REPORTS:  CIC will meet Monday January 19th at 5:30, Mike Harwood will be out of town, but the rest will meet. Hopefully we will have Mike’s information in hand to move forward. Mike- the information I am talking about. I have talked to the guy at Jake’s; he said send me a flyer. He recommend like a 3 X5 post card. I was going to do like a full sheet. Betty- so we just have to distribute them.  Mike- the agreement is for February instead of January; we are going to do the whole month and get 10%. Betty- we will have a donation from Jae Tech of $750.00 to pay for one sign. Jason- Mike if you get the information to me I can get it on our page. Mike- I was probably just going to staples or see if my wife can find a commercial printer that she works with and just do several thousands to start with. Troyers said they would hand them out with all their bags. Leonard will put them in his grocery bags. Betty- Paul said he would put a stack at the Bakery. Mike- that is what I meant. Mike- I think we should solicit up and down St. Rt. 30. You just need to walk in and hand your to your server. 10% of the bill goes to us. Betty- how much will it cost at staples? Mike- I don’t know; I may just make the donation. Betty- our copier here is pretty fast. Mike- I am going to design it with his wife. I was thinking about putting multiples and take them. I just want to get it designed. My wife just got back to work today. Betty- If all that changes maybe you would decide to go with the elementary design of using regular stock paper and cutting them in half. Maybe design it or power pint and we could print them out here. I can come down and give Laurie a hand or she can show me how to do it. Mike- we are going to distribute them everywhere we can. Betty- I will take some to my church; a lot of people go out to eat after church.
