May 4, 2015 Council Meeting Minutes

The Regular Meeting of the Apple Creek Council called to order on May 4, 2015 by Betty Keener with the following council members answering to roll call:

Rick Conrad-present, Mike Harwood-present, Rodney Mackey-present, Robert McCarthy-absent, Charlie Lewis-present, and Steve Stoffer-present.

Steve Stoffer made a motion to approve the minutes of the April 20, 2015 meeting, as always they are available for the public to review. Seconded by Mike Harwood. Roll Call: Steve Stoffer-yes, Mike Harwood-yes, Rick Conrad-yes, Rodney Mackey-yes, and Charlie Lewis-yes.

VISITORS: None.

Motion to go into executive session for Legal Section 121.22 (G)(8) by Mike Harwood. Seconded by Rodney Mackey. Roll Call: Mike Harwood-yes, Rodney Mackey-yes, Rick Conrad-yes, Charlie Lewis-yes, and Steve Stoffer. At 6:32 pm.

Motion to come out of executive session at 6:48 pm by Steve Stoffer. Seconded by Mike Harwood. Roll Call: Steve Stoffer-yes, Mike Harwood-yes, Rick Conrad-yes, Rodney Mackey-yes, and Charlie Lewis-yes.

ENGINEERS: Nothing.

POLICE: Jason Woodruff was present and handed out his report for the month. He has received a resignation from Dave Cimperman who is a part time officer. Mike Harwood made a motion to accept his resignation; seconded by Charlie Lewis. Roll Call: Mike Harwood-yes, Charlie Lewis-yes, Rick Conrad-yes, Rodney Mackey-yes, and Steve Stoffer-yes. Jason reported we are short one part time person because Robert Kern is still off work with a shoulder injury which is a Workers Comp situation with his full time employer. He is bringing in the orders from the doctor. Mayor Betty Keener told Jason that the village would need copies of all Workers Comp paperwork for our personnel records, and the Solicitor nodded in agreement. Jason presented an application for John Cole as an auxiliary officer. He has been out of this type of work for a while so he has to take a refresher course. This will be for 20 hours of schooling. Jason reported every officer now has a narc kit. They have to take a little training before they are qualified to use the kit. Steve Stoffer asked how AED’s we have may. Jason reported we only have one but would like to get more. They cost about $1,500 each new and $1,000 for a used one. Mike Harwood made a motion to place John Cole as an auxiliary officer on the condition he passed his refresher class. Seconded by Charlie Lewis. Roll Call: Mike Harwood-yes, Charlie Lewis-yes, Rick Conrad-yes, Rodney Mackey-yes, and Steve Stoffer-yes.

PARK: Betty Keener reported we don’t have as much in capital line as we thought; we only have $850.00 left to spend this year. The closure for the doors is between $39 and $49.00 dollars. Jason is going to order these for us. May 16th is the day the CIC has decided to work on the signs at both ends of town. If it rains, no new work date has been determined. We need stain for the signs at a cost of about $170.00. Rodney Mackey made a motion for the Village to purchase the stain. Seconded by Steve Stoffer. Roll Call: Rodney Mackey-yes, Steve Stoffer-yes, Rick Conrad-yes, Mike Harwood-yes, and Charlie Lewis-yes. We will inquire about using permissive tax for this expense.

STREETS AND MAINTENANCE: Dale Orr reported the backhoe is in the shop for repair and Melway will be in soon for the chip and seal.

WATER & SEWER: Betty reported she had talked to Gary Daugherty and the plans for the upgrade on the water treatment plant are almost done. He hopes to have them to the EPA by the middle of May and back to us in a month; however, that timeframe is discretionary according to the EPA. We will need to have financing in place. Hopefully, we can bid it by the July or August. We’re still on target to have this project completed by the end of the year. Betty stated for the record we have had some rude comments said about council and to council about the brown water. Council and I are getting brown water along with the community. My dishwasher is stained, my washer is stained and we are working hard to make this happen. This kind of thing just does not happen overnight. I will make sure that Jonathan at the Daily Record gets the whole story.

JEDD: Rodney Mackey reported they had a meeting and Steve Mast did not show up. We scheduled it on his terms but he was a no show. Fredericksburg Builders is showing their business address to be one and the same of the Jedd area. Betty advised Council that although Mr. Mast has applied for an extension to file his taxes, that he is not paying any withholding income tax to the village. Jeff will talk to the prosecutor’s office to pursue this issue.

 

CORRESPONDENCE: Betty reported she has a book from the Ester Marthy home; she feels it should go to the historical society. Also there is a Wayne County night to watch the Akron Rubber Ducks. Ticket order forms were provided.

 

UNFINISHED BUSINESS: New web-site is up and running.

NEW BUSINESS: Betty reported she had written a letter of support for Southeast Local Schools for the Daily Record. Betty will call Leonard Kaplan about the flags on ST. Rt. 250 that are torn. Steve Stoffer asked about the yard sale that has been going on for one month. How long before it’s a business. People are parking on the berms and it’s a dangerous situation. Jason will go out and talk to them.
