May 5, 2014 Council Minutes

The Regular Meeting of the Apple Creek Council called to order on May 5, 2014 by Mayor Judy Gatti with the following council members answering to roll call:

Betty Keener-present, Rick Conrad-present, Mike Harwood-present, Rodney Mackey-present, Robert McCarthy-present, and Steve Stoffer-arrived at 6:50 during executive session.

Mike Harwood made a motion to approve the minutes of the April 21, 2014 meeting, as always they are available for the public to review, Seconded by Rodney Mackey, Roll Call: Mike Harwood-yes, Rodney Mackey-yes, Rick Conrad-yes, Robert McCarthy-yes, and Betty Keener-yes.

Motion to go into executive session for personnel section 121.22 (G)(1)by Rodney Mackey, Seconded by Mike Harwood, Roll Call: Rodney Mackey-yes, Mike Harwood-yes, Rick Conrad-yes, Robert McCarthy-yes, and Betty Keener-yes. At 6:37 pm.

Steve Stoffer arrived at 6:50pm.

VISITORS: Abby from the Daily Record, Leonard Kaplan and Keith Wellman. Robert McCarthy reported he had talked to the Interim Director of ATI and he is working with Rob Kastner of Wayne County Soil and Conservation. Keith reported he had talked to someone at the state level and that individual plans on contacting ATI.

ENGINEERS: Nothing.

POLICE: Jason Woodruff was present and handed out his monthly report. The police department is still doing about the same number of calls. Jason plans on retiring Diesel (K-9) in September for health issues. Diesel is having hip problems; he has been offered a free puppy. The village incurs no cost for the K-9 unit as the Chief pays for the food and medical bills. Betty Keener made a motion to continue with the K-9 unit with Jason getting a new puppy, Seconded by Steve Stoffer, Roll Call: Betty Keener-yes, Steve Stoffer-yes, Rick Conrad-yes, Robert McCarthy-yes, Rodney Mackey-yes, and Mike Harwood-yes.

PARK: Mayer Carson hall is done except the paneling, they will be back on Wednesday, May 7th to finish the work. Board of Elections is there on Tuesday May 6, 2014. Michael Cole would like the village to donate the use of the ball diamond on May 24th for a softball tournament to benefit Jeff Kaser who passed away. This is help the family pay for the medical expenses and funeral. Rodney Mackey made a motion to allow Michael Cole to use the baseball diamond at the park on May 24th for the softball tournament. They are not requesting use of Mayer Carson hall. STREETS AND MAINTENANCE: Ordinance 2014-7 An Ordinance Amending the 2014 Appropriation Ordinance 2014-1 Passed January 13, 2014 and Declaring an Emergency.
Motion to suspend the rules and advance to the second and third reading by title only, Motion by Mike Harwood, Seconded by Steve Stoffer, Roll Call: Mike Harwood-yes, Steve Stoffer-yes, Rick Conrad-yes, Robert McCarthy-yes, Betty Keener-yes, and Rodney Mackey-yes.

Motion to pass Ordinance 2014-7 by Rodney Mackey, Seconded by Mike Harwood, Roll Call: Rodney Mackey-yes, Mike Harwood-yes, Steve Stoffer-yes, Rick Conrad-yes, Robert McCarthy-yes, and Betty Keener-yes.

Resolution 2014-8 A Resolution Transferring Monies From the General Fund to the Street Fund. Motion to pass by Rick Conrad, Seconded by Mike Harwood, Roll Call: Rick Conrad-yes, Mike Harwood-yes, Steve Stoffer-yes, Robert McCarthy-yes, Betty Keener-yes, and Rodney Mackey-yes.

Keith Wellman asks why on Park Dr the concrete barriers are blocking off part of road. He is having a problem making the turn with his camper. Dale Orr explained the barriers are there to keep the big trucks off the road. Park Drive does not have the base for heavy trucks. We have signs posted “no thru trucks”, but the trucks continued to use that street. Discussion continued that Steve Stoffer and Mike Harwood did not think the barriers are attractive and take away from the aesthetics of the street.

WATER & SEWER: The plug that was placed in the line coming down from ACDC on ATI property has blown out. Kevin Dean will be placing it up higher on the hill. Researching the Tap In fees, the only village that pays for the actual work is Shreve. Decided to have the Water & Sewer committee to review this subject and come back to council. The meeting for Water & Sewer will be June 2 at 5:30. Keith Wellman asked about his sewer line, he is having backup into his house. He would like to put a check valve in. He can install this check valve, but should be able to reach it in case it stays open. This is on private property and he needs to hire a plumber to fix this.

JEDD: Nothing.

CORRESPONDENCE: Nothing.

UNFINISHED BUSINESS: Jeff Musselman reported he had talked to Mr. Arnold about the run off and Mr. Arnold would be willing to talk to people about this and Jeff has his number.

NEW BUSINESS: There was never anything about a council person being late for a meeting due to a Fire Department or EMS call. Jeff will have an Ordinance for the first meeting in June. The new Ordinance will not affect any other type of tardiness.

COMMITTEE REPORTS: Judy reported that the CIC is not just another committee for her to appoint members. It is separate from the Village. The Mayor is always on it and two members from council. Rick Conrad nominated Rodney Mackey, Steve Stoffer nominated Mike Harwood and Rodney Mackey nominated Betty Keener. Jeff stated that the bylaws could be changed to three members of council. The CIC will meet at 5:30 on May 19th and the first thing on the agenda will be to change the by-laws.
