Meeting Minutes May 16, 2016

 

The Regular Meeting of the Apple Creek Village Council was called to order on May 16, 2016 by Mayor Betty Keener with the following council members answering to roll call:

Rick Conrad-present, Mike Harwood-present, Rodney Mackey-present, Robert McCarthy-present, Charlie Lewis-present and Steve Stoffer-present.

Council President Mackey made a motion to approve the Minutes (as amended) of the May 2, 2016 meeting, as always the minutes are available for the public to review. The motion was seconded by Councilperson McCarthy. Roll call vote was as follows: Council President Mackey-yes, Councilperson McCarthy-yes, Councilperson Conrad-yes, Councilperson Harwood-yes, Councilperson Lewis-yes and Councilperson Stoffer-yes.  Motion carried.

VISITORS: None were present.

POLICE:  The Dodge Charger is fixed and back on the road.  T-shirts are being sold as a fund-raiser.  The first batch has been sold-out, and Sgt. Estacion reported that more T-shirts are being ordered.

Mayor Keener reported there is a new business recently established in town. It is located in the plaza with the Dollar General. The owners came to the Town Hall, introduced themselves and gave certificates to the employees. The business offers massage therapy as one of their services.

PARK: Nothing.

STREETS AND MAINTENANCE: Third Reading of Ordinance 2016-13, An Ordinance Granting Director of Transportation Authority to Maintain State Highways, Apply Standard Longitudinal Pavement Markings and Erect Regulatory and Warning Sings on State Highways Inside Village Corporation.  

A motion to pass Ordinance 2016-13 was made by Councilperson Conrad, and seconded by Councilperson Harwood. Roll call vote was as follows: Councilperson Conrad-yes, Councilperson Harwood-yes, Council President Mackey-yes, Councilperson McCarthy-yes, Councilperson Lewis-yes, and Councilperson Stoffer-yes. Ordinance passed.

Resolution 2016-16, A Resolution Authorizing Participation in the ODOT Winter Contract (018-17) for Road Salt.

A motion to pass Ordinance 2016-16 was made by Councilperson Lewis and seconded by Councilperson McCarthy.   Roll call vote was as follows: Councilperson Lewis-yes, Councilperson McCarthy-yes, Councilperson Conrad-yes, Councilperson Harwood-yes, Council President Mackey-yes, and Councilperson Stoffer-yes.  Ordinance passed.

Ordinance 2016-17, An Ordinance Granting a Driveway Easement to Richard E. Sloan, and authorizing the Mayor to execute said Easement, and declaring an emergency. Discussion was held on the Ordinance.  This easement is located near the Village garage.  Owners will help pay for the driveway maintenance the Mayor stated

A motion to suspend the rules and advance to the second and third reading by title only was made by Councilperson Conrad and seconded by Councilperson Stoffer. Roll call vote was as follows: Councilperson Conrad-yes, Councilperson Stoffer-yes, Councilperson Harwood-yes, Council President Mackey-yes, Councilperson McCarthy-yes, and Councilperson Lewis-yes.  Motion carried.

A motion to pass Ordinance 2016-17 was made by Councilperson Stoffer and seconded by Councilperson Conrad. Roll call vote was as follows: Councilperson Stoffer-yes, Councilperson Conrad-yes, Councilperson Harwood-yes, Council President Mackey-yes, Councilperson McCarthy-yes, and Councilperson Lewis-yes.  Motion carried.

WATER & SEWER: Presently, there is no scheduled time for the cleaning of the water towers.  It is expected to be done late in June.

Second Reading of Ordinance 2016-14, An Ordinance Requiring Water and Sewer Accounts be Titled in Property Owners’ Names, and Thereby Amending Ordinances 2015-9, 2015-8, 2012-24, 2012-23, 2009-16 and 2009-15, and repealing Prior Inconsistent Ordinances and Resolutions. The Third reading will be June 6, 2016.

Ordinance 2016-18, An Ordinance Approving the Terms of an Acquired Easement From Village Ag-Land, LLC, Authorizing the Mayor to Execute Said Easement, and Declaring an Emergency.

Roll call vote was as follows: Councilperson Harwood-yes, Councilperson McCarthy-yes, Councilperson Conrad-yes, Council President Mackey-yes, Councilperson Lewi-yes, and Councilperson Stoffer-yes. Motion carried.

Council President Mackey asked if a letter has been sent to residents (along the Waynedale Project line). The Mayor responded that it has not yet been sent because the letter should be sent one month prior to going-out-to bids.  At this point, it is unknown when the project will go to bid.  President Mackey suggested including in the letter the 2015 sewer rule changes that have been promulgated by the Department of Health.  This will alert the property owners to the costs of system upgrades if they fail to tap-in to the Waynedale Project.   Councilperson Harwood suggests sending the letter sooner than one month prior to bidding.  The Mayor reported that the engineer is still changing the project.  She suggests that as soon as the changes are completed, the letter could then be sent.  President Mackey further suggests including the costs for tap-ins, so property owners can compare expenses of upgrading to comply with the new Health Department rules.  Councilperson Stoffer suggested sending a letter with the Health Department rules at this time and a follow-up letter at a later date to give more time for property owners to decide whether to tap-into the Waynedale line or not.

The Mayor reported that The Daily Record Reporter who covered Apple Creek business has relocated out of state. A new Reporter has not been assigned so it’s unknown when we’ll have newspaper coverage again. Historically it was several council meetings. It may take some time for a new reporter to be assigned.

UNFINISHED BUSINESS: Nothing

NEW BUSINESS:  Councilperson McCarthy talked about the company hired last year for weed control. They were to have sprayed the catch basin in the flats by the creek at the east end of town but sprayed the gully instead.  There was ground cover to keep erosion from occurring.  Since the gully was sprayed, nothing has grown there and erosion is terrible now.  Dale will be asked what was sprayed exactly.  The company should be coming back this year.

COMMITTEE REPORTS: Mayor Keener reported that the CIC met tonight and they are moving forward with the band stage at the park.

Roll call vote was as follows: Councilperson Conrad-yes, Councilperson McCarthy-yes, Councilperson Harwood-yes, Council President Mackey-yes, Councilperson Lewis-yes, and Councilperson Stoffer-yes.  Motion carried.

The preliminary budget for 2017 was given to Council for review prior to approval. Digitalizing Village records was discussed.  This project has been included in the 2017 budget, $6,000.00 in general with $3,000 in both water and sewer for a total of $12,000.00.  The Mayor suggested to Council that they write down questions and/or suggestions regarding the budget.
