ORDINANCE NUMBER 2015 -21
AN ORDINANCE APPROVING THE APPLE CREEK – EAST UNION TOWNSHIP JOINT ECONOMIC DEVELOPMENT DISTRICT 2 CONTRACT AND DECLARING AN EMERGENCY.
WHEREAS, the Village of Apple Creek (the “Village”) and the Township of East Union (the “Township”) have negotiated and now intend to enter into an Apple Creek – East Union Township Joint Economic Development District 2 Contract to create and provide for the operation of the Apple Creek – East Union Township Joint Economic Development District 2 (the “District”) in accordance with Section 715.72 of the Revised Code for their mutual benefit and for the benefit of their residents, Southeast Local School District and of the State of Ohio (the “State”).
NOW, THEREFORE, BE IT RESOLVED by the Village of Apple Creek, County of Wayne, State of Ohio, that:
Section 1. The Village Council finds and determines that:
(A) Village Council has held a public hearing concerning the Contract at 6:00 o’clock P.M., on August 3, 2015, in accordance with Section 715.72 of the Revised Code;
(B) 30 days’ public notice of the time and place of that public hearing was provided in The Daily Record, a newspaper of general circulation in the Village;
(C) during the 30-day period prior to that public hearing, a copy of the text of the Contract, together with copies of District maps and plans related to or part of the Contract, were placed on file for public examination in Town Hall with the Fiscal Officer; and
(D) the opportunity for public comment and recommendations on the proposed Contract was be presented at the public hearing.
Section 2. This Village Council approves the Apple Creek – East Union Township Joint Economic Development District 2 Contract (the “Contract”) now on file with the Fiscal Officer (see attached Exhibit “A”, incorporated herein by reference). The Contract shall be signed by the Mayor on behalf of the Village.
Section 3. A copy of the text of the Contract, together with copies of District maps and plans related to or part of the Contract, shall remain on file in the office of the Fiscal Officer.
Section 4. This Village finds and determines that all formal actions of this Council concerning and relating to the adoption of this ordinance were taken in an open meeting of this Village Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
Section 5. This Ordinance is hereby declared an emergency measure necessary for the immediate preservation of the public health, safety and welfare. Therefore, this ordinance shall go into immediate effect.
Section 6. All prior ordinances and resolutions which conflict with the provisions of this resolution are hereby repealed to the extent that they are in conflict herewith.
Section 7. If any provision of this Ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of this resolution which can be given effect without the invalid provision or application, and to this end the provisions are severable.
