ORDINANCE NUMBER 2015 -29
AN ORDINANCE TO PROHIBIT PARKING OF VEHICLES, TRAILERS, MOTOR HOMES, MOTOR VEHICLES, SEMI-TRAILERS AND BOATS FOR UNAUTHORIZED PURPOSES AND EXTENDED PERIODS IN THE VILLAGE PARK.
WHEREAS, the prolonged parking of vehicles, trailers, motor homes, motor vehicles, semi-trailers, and boats in the Village Park is a safety hazard, and;
WHEREAS, said parking interferes with the public enjoyment of the Village Park as well as the ability of Village employees to safely maintain the Park grounds;
NOW, THEREFORE, BE IT RESOLVED by the Village of Apple Creek, County of Wayne, State of Ohio, that:
No person shall park any vehicle, trailer, motor home, motor vehicle, semi-trailer or boat in the Village Park (as located on Mill Street & Park St.) at any time unless such parking is in connection with an immediate and lawful use of the park by the operator of said vehicle or its passengers.
Nothing in this Section shall be construed so as to prohibit the use of said parking facilities at any time by emergency vehicles or municipal vehicles of the Village of Apple Creek.
All motorized vehicles must remain in the parking lots and are not allowed on any off-road areas such as grass, fields or recreational courts.
Any resident of the Village may request the issuance of a temporary permit as a special exception from this parking prohibition. A temporary permit will be valid for no more than forty-eight (48) hours, and the holder will be limited to no more than one such request in any thirty (30) day period. Such a request shall be made in writing to the Apple Creek Village Council Park Committee no less than thirty (30) days prior to the requested issuance date, and shall include a brief description of the nature of the request. There will be no fee for this permit. A temporary permit shall not be issued unless the Park Committee determines that issuance of this special exception in no way constitutes a nuisance or is detrimental to the health, safety, welfare or quiet enjoyment of the park’s neighboring land owners or the Village of Apple Creek, Ohio.
Any violation of this ordinance shall constitute a minor misdemeanor. Each day=s violation shall constitute a separate offense.
All prior ordinances and resolutions which conflict with the provisions of this resolution are hereby repealed to the extent that they are in conflict herewith.
If any provision of this Ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of this resolution which can be given effect without the invalid provision or application, and to this end the provisions are severable.
This Ordinance shall be posted or published in the newspaper of general circulation and shall be in full force and effect upon its passage and publication, as provided by law.
