ORDINANCE 2017-11 Granting Electrical Outlet

 ORDINANCE NUMBER 2017- 11      

AN ORDINANCE GRANTING THE EXTENSION AND USE OF AN ELECTRICAL OUTLET IN APPLE CREEK CEMETERY FROM THE VILLAGE TO THE APPLE CREEK CEMETERY ASSOCIATION, AND DECLARING AN EMERGENCY.

WHEREAS, the Village of Apple Creek owns real estate abutting the Apple Creek Cemetery; and

WHEREAS, the Apple Creek Cemetery Association maintains a storage garage on said property; and

WHEREAS, electrical services are needed to said building in order to charge batteries for maintenance of the cemetery property; and

WHEREAS, the Cemetery Association has historically used an electrical outlet on the village’s nearby water tower to charge said batteries; and

WHEREAS, it is now desired that said electric outlet be extended underground from the water tower to the storage garage for ease of use; and

WHEREAS, in the interests of public health and safety that an underground electric line be extended from the water tower to the existing storage garage;

NOW THEREFORE, BE IT RESOLVED by the Council of the Village of Apple Creek, Ohio, that:

SECTION ONE:

The Apple Creek Cemetery Association is hereby authorized to extend an electric line from the Village’s water tower abutting Apple Creek Cemetery to the existing storage garage on said property.  Said electric line shall be placed underground, limited to 110 volts, and its location and method of construction shall be preapproved by authorized village representatives or employees.  Affirmative measures shall be taken to ensure utmost safety for the public and users of said outlet.

SECTION TWO:

The Apple Creek Cemetery Association shall be permitted to use said 110 volt electric outlet for purposes of charging batteries used in the maintenance of the Apple Creek Cemetery.  Said use shall be at no charge to the Apple Creek Cemetery Association so long as said use is within normal parameters of the Association’s historic electrical use.  Any unauthorized increase in use may cause immediate termination of said services by the Village.

SECTION THREE:

This Ordinance is hereby declared to be an emergency measure and shall take effect and be in force immediately from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of public health, safety and welfare.

SECTION FOUR:

Any prior Ordinances which conflict with the provisions of this Ordinance are hereby repealed to the extent that they are in conflict herewith.

SECTION FIVE:

If any provision of this Ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions are severable.
