ORDINANCE NUMBER 2017- 8

AN ORDINANCE LISTING FOR SALE THAT PROPERTY KNOWN AS THE SOUTH PART OF LOT 45 IN THE VILLAGE OF APPLE CREEK (COMMONLY KNOWN AS THE “WOODEN NICKEL” LOT) WITH RE/MAX SHOWCASE FOR A TERM OF SIX MONTHS AT THE LISTING PRICE OF $10,000.00, AUTHORIZING THE APPLE CREEK COMMUNITY IMPROVEMENT CORPORATION TO EXECUTE SAID LISTING AGREEMENT, AND DECLARING AN EMERGENCY.

WHEREAS, the Village of Apple Creek presently owns the south part of lot 45 in the Village of Apple Creek, commonly known as the “wooden nickel” lot, (see attached Exhibit “A”  for legal description); and

WHEREAS, the Village of Apple Creek has designated the Apple Creek Community Improvement Corporation as an agency of the village in accord with ORC 1724.10; and

WHEREAS, the Village of Apple Creek’s Council has determined that the subject real property is not required for its purposes, and that sale of said property would promote the welfare of the Village’s citizens, as well as those other economic benefits enumerated in ORC 1724.10(B); and

WHEREAS, Apple Creek’s village council hereby desires to empower the Apple Creek Community Improvement Corporation with authority to list said real property for sale with RE/MAX for a term of six (6) months and a listing price of $10,000; and

WHEREAS, as time is of the essence this ordinance requires emergency action;

NOW THEREFORE, BE IT RESOLVED by the Council of the Village of Apple Creek, Ohio, that:

SECTION ONE:

The Apple Creek Community Improvement Corporation, by and through its president Rodney Mackey, shall execute a sales listing agreement regarding that property identified in Exhibit “A” (attached hereto) with RE/MAX  for a term of six months, at a listing price of Ten Thousand and 00/100 Dollars ($10,000.00), subject to the terms and conditions of said listing agreement (attached hereto as Exhibit “B”).

SECTION TWO:

Title to said real property shall be transferred to the Apple Creek Community Improvement Corporation prior to approval and consummation of any sale, which shall be subject to the sole and exclusive authority of Village Council.

SECTION THREE:

This Ordinance is hereby declared to be an emergency measure and shall take effect and be in force immediately from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of public health, safety and welfare.

SECTION FOUR:

All prior Ordinances which conflict with the provisions of this Ordinance are hereby repealed to the extent that they are in conflict herewith.

SECTION FIVE:

If any provision of this Ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions are severable.
